NO. SEXUAL ORIENTATION is NOT a protected class. 

 
Earlier today I wrote about the fact that St Augustine announced today that it is adding Sexual Orientation to the Fair Housing Laws. The comments I received on Facebook all were roughly the same. "Isn't that already a protected class by the Federal Government?" The answer, sadly, is NO! The Federal Government finds seven classes protected:
 
  • Race
  • Color
  • Religion
  • Sex
  • Handicap status (mental or physical)
  • Familial status (families with children younger than 18 and pregnant women)
  • National Origin
Contrary to popular belief, Sex, under the Fair Housing Law, only means that you cannot discriminate against men or women. As you can see, Familial Status only means that you can't say a single woman (or man) with a child, or a pregnant unmarried woman, cannot be discriminated against. 
 
Regardless of your belief on the topic of gay marriage, housing is a basic human right and the fact that you love and want to cohabitate with someone of the same sex should not prohibit you from owning or renting a home or apartment unit. Currently, since it is not a protected class, it can. 
 
Understanding the laws and creating an awareness of them can help us change both local and federal laws.
